Terms of Service
Welcome to Bindi. These Terms of Service ("Terms") govern your access to and use of the Bindi website at bindi.coach, the Bindi web application at app.bindi.coach, and any related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use Bindi. By creating an account, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
2. Your Account
To access certain features, you must create an account using Google Sign-In. You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to notify us promptly at 0800.grc@gmail.com if you suspect unauthorized access.
You agree to provide accurate information during registration and to keep it up to date. We reserve the right to suspend or terminate accounts that violate these Terms.
3. Description of Service
Bindi is an AI-powered career mentoring platform that provides personalized career development plans, learning content, and AI-assisted guidance. The Service includes:
- Personalized career journey creation and tracking
- AI-generated career guidance and learning topics
- Content downloads (PDF) for paid plans
- Team management features for business plans
Bindi uses artificial intelligence to generate recommendations and content. AI-generated outputs are provided for informational and educational purposes only and should not be treated as professional career advice, legal advice, or any other form of certified professional counsel.
4. Plans, Payments, and Refunds
4.1 Free Plan
Bindi offers a free tier with limited features. No payment is required for the free plan.
4.2 Paid Plans
Paid plans (Learner, Mentor, Journey, and any future offerings) are one-time purchases that grant permanent access to their respective features, unless otherwise stated at the time of purchase. Prices are displayed in US dollars and are subject to change for future purchases.
4.3 Payment Processing
Payments are processed securely through Stripe. Bindi does not store your credit card information. By making a purchase, you also agree to Stripe's Terms of Service.
4.4 Refunds
Due to the digital nature of the Service, all sales are final. If you experience a technical issue preventing access to paid features, contact us at 0800.grc@gmail.com and we will work to resolve it. Refund requests may be considered on a case-by-case basis at our sole discretion.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to any part of the Service or its systems
- Interfere with or disrupt the Service or servers connected to it
- Use automated tools (bots, scrapers, etc.) to access the Service without our written permission
- Reverse engineer, decompile, or disassemble any part of the Service
- Reproduce, redistribute, or resell any content generated by the Service
- Impersonate any person or entity, or misrepresent your affiliation
- Upload or transmit viruses, malware, or other harmful code
6. Your Content
You retain ownership of any content you provide to the Service (such as career goals, responses, and profile information). By submitting content, you grant Bindi a non-exclusive, worldwide, royalty-free license to use, process, and store that content solely for the purpose of providing and improving the Service.
You are solely responsible for the content you provide. You represent that you have all necessary rights to submit it and that it does not violate any third party's rights.
7. AI-Generated Content
The Service uses third-party AI providers (such as OpenAI and Anthropic) to generate career plans, learning content, and guidance. You acknowledge that:
- AI-generated content may not always be accurate, complete, or up to date
- AI outputs do not constitute professional advice of any kind
- You should independently verify any important information before relying on it
- Bindi is not liable for decisions you make based on AI-generated content
8. Intellectual Property
The Service, including its design, code, text, graphics, logos, and overall look and feel, is owned by Bindi and protected by intellectual property laws. These Terms do not grant you any rights to use Bindi's trademarks, logos, or branding without prior written consent.
9. Third-Party Services
The Service integrates with third-party services including Google (authentication), Stripe (payments), and AI providers (content generation). Your use of these services is subject to their respective terms and privacy policies. Bindi is not responsible for the practices or availability of third-party services.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Bindi does not warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected. Bindi does not guarantee the accuracy, completeness, or usefulness of any AI-generated content.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BINDI AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
BINDI'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO BINDI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify and hold harmless Bindi and its operators from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
13. Termination
You may stop using the Service at any time. Bindi may suspend or terminate your access at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) shall survive.
14. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where feasible, notify you via the Service or email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Brazil.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bindi regarding the Service and supersede any prior agreements.
